INTRODUCTION
This American Heritage Bank Online Banking Agreement and Disclosure Statement (the “Agreement”) governs the terms and conditions that apply when you use our Online Banking services.
This Agreement supplements the AHB Deposit Account Agreement and Disclosures and any other agreement between you and AHB. This agreement applies to both consumer and commercial customers unless specified otherwise. In the event of any conflict with any other agreement regarding AHB Online Services, this agreement will control.
The terms "you" and "your" refer to each person who is authorized to use an Online Banking User Identification Number (ID) and Password. "We", "us", "our" "AHB" and "Bank" refer to American Heritage Bank. The term "Online Services" refers to any combination of our online services accessed over the Internet using a personal computer and modem, mobile phone, or personal data device. "Online Banking" and "Internet Banking" are used interchangeably to refer to the service that allows you to access your AHB accounts and perform transactions. "eStatements" refers to our service that allows you to be notified by email and "pull" your periodic statements from a secure site, rather than receiving them in print. "Mobile Banking" refers to our mobile version of Online Banking.
PLEASE READ THIS ENTIRE AGREEMENT PRIOR TO USING AHB'S ONLINE SERVICES. BY USING ANY OF AHB'S ONLINE SERVICES, YOU ACKNOWLEDGE YOUR RECEIPT AND UNDERSTANDING OF THIS DISCLOSURE AND AGREE TO ALL TERMS AND CONDITIONS OF THIS AGREEMENT.

Account Eligibility
Online Banking is available to any account holder. Online Banking is available to any account holder. You must be an owner of a Deposit Account or Loan Account in order to access it through the Online Banking Service. Eligible new Deposit Accounts or Loan Accounts that you open with the Bank after your initial enrollment in Online Banking will be enabled in Online Banking.

With AHB Online Banking you can instantly access your Checking, Savings, CD, IRA, and Loan accounts, and;

- Review transaction history since your last statement.
- View check images.
- Transfer funds between your AHB accounts.
- Print your history information.
- Download account information into compatible money management software.
User ID and Password
Each time you access Online Banking you must use the User Identification Number (ID) provided by the bank or an alias you have entered and an alphanumeric Password. The first time you access Online Banking, you will enter your default Password. Then you must change your assigned Password to a new alphanumeric Password of your choice.

You are responsible for keeping your User ID and Password private. Anyone to whom you give your User ID and/or Password will have access to your accounts. You are liable for all transactions performed by you or anyone to whom you reveal your User ID and/or Password. If you think your User ID and Password have been lost or stolen, immediately notify our customer service department at (918) 224-3210.
Limits on Online Banking Transactions
Transactions conducted via Online Banking are subject to all withdrawal and transfer limitations and excess activity charges described in the AHB Deposit Account Agreements and Disclosures.

Authorizations
Each owner of a Deposit Account or Loan Account is authorized to access all of the funds held in that Deposit Account or Loan Account.The Bank is entitled to act on transaction instructions received using your user ID, password and enhanced login security information, and you agree that the use of your name, password and enhanced login security information will have the same effect as your signature authorizing the transaction.

Limitations on Frequency of Transfers (Savings and Money Market Accounts)
Transfers, cash withdrawals or a combination thereof from these accounts to another account of the depositor at the same institution are unlimited as long as the transactions are made in person, by mail, messenger, or automated teller machine.

A fee of $5.00 may apply for withdrawals over the limit of six (6) in any calendar month or similar period of at least four weeks and may be charged quarterly. Exceeding these limits regularly may result in the loss of transfer capabilities or the need to open a different type of account.
Stop Payments
A stop payment order must be given in the manner required by law and must be received in time to give us a reasonable opportunity to act on it before our stop-payment cut-off time. Our stop-payment cut-off time is one hour after the opening of the next banking day after the banking day on which we receive the item. Additional limitations on our obligation to stop payment are provided by law. A stop-payment order must precisely identify the number, date and amount of the item, and the payee. Other rules apply.

Hours of Accessibility
In general, AHB Online Banking is accessible 24-hours per day, seven days a week; however, AHB does not guarantee that Online Banking will be available at all times. Occasionally, due to system maintenance or reasons beyond our control, Online Banking may be unavailable.

Transactions are processed on business days only. Every day is a business day except Saturdays, Sundays, and Federal Holidays. A transfer initiated before 6:30 p.m. CST on a business day is posted to your account the same day. A transfer completed after 6:30 p.m. CST on a business day or on a non-banking day, as specified above, will be posted on the next business day.
If Online Banking is not accessed for six (6) months, it will become dormant or inactive. To reactivate, contact Customer Service at (918)224-3210. If Online Banking is not accessed for one (1) year, it will be automatically deleted.
Our Liability for Failure to Complete Transfers
We will take reasonable care to complete funds transfers according to your instructions. Examples of situations in which AHB is not responsible for completing transfers include, but are not limited to, the following:

- If you do not have enough available money in an account from which a transfer is to be made.
- If your account is closed or is not in good standing.
- If legal order directs us to prohibit withdrawals from your account.
- If you or anyone you authorize commits any fraud or violates any regulation.
- If your equipment, or our equipment, was not working properly and the breakdown should have been apparent to you when you attempted the transaction.
- If you have not provided the information necessary to complete the transaction.
- If you have provided us with inaccurate information or fail to correct inaccuracies of which you are aware.
- If you did not properly follow instructions for using Online or Mobile Banking.
- If, despite our precautions, circumstance beyond our control prevent, delay, or alter the transaction.

The bank's Paid Overdraft/Returned NSF fee includes transactions such as: checks, in person withdrawals, ATM withdrawals, or other electronic or paper items.

AHB will not provide separate receipt or documentation for transfers conducted via Online Banking.Your Online Banking transfers will appear on your account statement. You agree to notify us promptly if you change your address.

eStatements for your eligible Checking, Money Market and Savings Accounts are available through Online Banking. We will archive eStatements for your eligible Account(s) beginning on the date of the first eStatement you receive after enrolling through Online Banking. We will continue adding your most recent eStatement to the archive each month until the archive contains 18 months of eStatements. After that, you will be able to access the most recent 18 months of eStatements.

Questions or Error Corrections on AHB Online Banking Transactions
Call or write AHB as soon as possible if you think your statement or receipt is wrong or if you need more information about a transfer or bill payment listed on a statement or receipt. We must hear from you no later than 60 days after we send you the FIRST statement on which the problem or error appeared.

If your User ID and Password have been compromised and you tell us within two business days after you learn of the loss or theft, you can lose no more than $50 if someone used your User ID or Password without your permission to access a deposit account. If you do not tell us within two business days after you learn of this loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500.
Also, if your statement shows withdrawals, transfers, or purchases that you did not make or authorize, please notify us at once. If you do not notify us within 60 days after the statement was sent to you, and we could have stopped someone from taking money if you had told us in time, you may not get any money after 60 days. If extenuating circumstances, such as a long trip or hospital stay, kept you from telling us, the time periods in this section will be extended.

The Commercial Online Banking Bill Payment Authorization Resolution signed by authorized agent(s) of your organization does save, hold harmless, and indemnify Bank for any damages to the organization caused by any negligent act or omission, misuse or unauthorized use of this product and none of the provisions set forth for consumer customer above apply.

Either you or we may terminate this Agreement and any of the Online Services at any time upon giving the other party at least 10 business days written notice of termination. If you terminate your AHB Online Service, we reserve the right to continue making previously authorized transfers, bill payments, and other transactions until we have a reasonable opportunity to act upon your termination notice. Once any of your Online Services are terminated we will make no further transfers, bill payments, or other transactions you have previously authorized.
Either you or we may terminate this Agreement and any of the Online Services at any time upon giving the other party at least 10 business days written notice of termination. If you terminate your AHB Online Service, we reserve the right to continue making previously authorized transfers, bill payments, and other transactions until we have a reasonable opportunity to act upon your termination notice. Equipment and Software
You are responsible for the operation and maintenance of your computer and software. AHB is not responsible for any errors or problems related to your computer hardware, software, or Internet access, for fees assessed by your telephone company, Internet service provider, or any other outside party.

Customers are responsible for making sure the computer they are using to access AHB Online Services is protected from and free of spyware and viruses, worms, Trojan horses, or other similar harmful components (collectively, referred to as "viruses"), which could result in damage to programs, files, and/or hardware or could result in information being intercepted by a third party. AHB will not be responsible or liable for any indirect, incidental, special or consequential damages that may result from such harmful components being present on the computer nor will AHB be responsible or liable if sensitive information accessed via AHB Online Banking is intercepted by a third party due to any of the above named "viruses" residing or being contracted by the customers computer at any point or from any source.

You may choose to communicate with AHB using electronic mail. However, be advised that email transmissions are not secure. We strongly discourage you from sending confidential account information to AHB via email. AHB is not responsible for any error or problems of any kind involving your email. At no time will any AHB employee ask for confidential information over email.
